Reservations are only valid once appropriate payment of a deposit has been received and accepted by the Owners. Payment of this deposit confirms that the Payee has been authorized by all Guests to accept all of the following mandatory terms and conditions and the Payee accepts legal responsibility for the agreed payments in their entirety.
A deposit of 20% of the total rental cost is required at the time of booking to secure the reservation. The balance due must be paid not less than 90 days prior to arrival, or in full when arrival is less than 90 days. We reserve the right to cancel your booking and retain the deposit if said payment(s) are not received as described above.
3. SECURITY DEPOSIT
A refundable security deposit of £200 is required with the payment of the final balance, to cover any loss or damage that may occur during your stay in the property. This will be returned in full within 30 days of your departure, providing no loss or damage is reported by the Property Manager. Should loss or damage occur, a deduction will be made by the amount of replacement, repair required, and the balance returned.
Such deductions would be made due to:
i. damage to the property or furnishings,
ii. dirt or other mess requiring cleaning beyond standard hygiene; or
iii. any other cost incurred by the Homeowner due to the Guest’s stay,
iv. blocking of the septic system / pipes if it is found that female sanitary products or other obstructive materials have blocked the pipes at the property.
Please note the examples I to iv is not an exclusive list and that the deposit may be retained for any other foreseeable damage or loss at the property.
4. CANCELLATION (Updated in response to COVID-19 emergency)
Bookings cancelled at least 14 days before the start of stay will receive 100% refund. Bookings cancelled at least 7 days before the start of stay will receive a 50% refund
Thus, it is suggested that you have adequate insurance in place. If you wish to make a change to your booking, then the Owners must be notified in writing and every effort will be made to assist where possible. If through circumstances beyond our control, it is necessary to cancel the booking agreement prior to travel, then the Owners will refund all monies paid by the Customer without interest or compensation, the basis for this limitation is in respect of unforeseeable/frustrating factor(s), that do not relate to any failing(s) by the Owners, i.e. matters beyond the Owners’ control. The Owners may at their discretion offer substitute accommodation of equal or higher standard, as an alternative to a full refund.
5. ARRIVAL & DEPARTURE
The rental period commences at 16.00 hours on the day of arrival and ceases at 10.00 on the day of departure. The set times are in order to allow adequate time to prepare the property for the forthcoming Guests. If any member of the Party stay beyond 10.00 hours without the consent in writing of the Owners, then we reserve the right to invoice the Guests in respect pf extra days spent at the property and for any other loss caused to the Owners as a result of disturbance made to future Guests, who would be using the property, had it not been occupied through the late departure of your party.
6. SWIMMING POOL
The property has a private swimming pool. The Owners do not accept any liability whatsoever for any injury however caused as a result of the use of the pool. Children (persons under 18 years) of age must be supervised at all times, no diving is allowed and absolutely no glasses or accident-prone material(s) should be taken near the pool.
No items are to be removed from the property including linen and towels. Guests must use their own towels for the beach and furniture must not be moved between rooms unless previously requested.
Antigua is a tropical island and as such insects and small creatures are inevitable and thus not regarded as a cause for complaint. To minimize nuisance levels and reduce risk please do not leave food on counter tops or by the pool area, remove garbage regularly and clean all spills immediately.
The property is rented on a self-service basis. You are responsible for purchasing food, drinking water, paper goods, cleaning supplies and other necessities during your stay. There will be an initial supply of water, certain beverages, soap, dish washing liquid and bathroom tissue supplied.
10. YOUR RESPONSIBILITY
Ffryes Villa is you home for your vacation so please treat the property, its furniture, fittings, utensils, and other facilities with respect. To minimize the risk of a potential loss of your security deposit, any loss, damage or non-working items should be reported to the Owners local representative immediately. Repair or replacement will be organized at the first opportunity. A fair use policy applies to the use of energy and water and the owners reserve the right to withhold any monies from the security deposit to pay for any loss, damage or excess. Air conditioning must be turned off at all times when the property is not occupied or when the rental concludes. Further, parties must also turn off the air conditioning if doors / windows are open. It is also requested that the property is returned in a reasonable state of cleanliness for the domestic staff to complete their work.
11. TRAVEL INSURANCE
It is a condition that all members of the party have correct travel documentation, plus adequate travel, third party liability cover, medical insurance for the period of the rental. It is also required that all members have a full passport valid for 6 months beyond the scheduled departure and the owners accept no responsibility for refusal of entry or exit to and from Antigua.
The Owner is not responsible for loss of personal belongings or valuables brought to the property by the guest(s). By accepting this reservation, it is agreed that all guest(s) are expressly accepting responsibility for their own physical safety through the use of the premises or others whom they invite to use the premises. The Owner does not accept any liability whatsoever for death, illness, personal injury, accidents, loss or damage to persons or the loss or damage of their personal effects, however caused while on the premises or its facilities. The Owners will, however, honour their legal responsibilities in providing accommodation that meets all required safety standards for letting purposes. Whenever possible, valuables should be left secure and out of sight. All doors and windows should be closed and locked, when any part of the premises is unoccupied.
If there is inclement weather, storm or hurricane, no refunds will be given should the guest(s) not be able to stay on the dates previously booked. Nor if the state or local authorities order mandatory evacuations in a “Tropical Storm/Hurricane Warning area”, nor for any advance rents collected or deposited for a reservation that is scheduled to arrive during the “Hurricane Warning” period. Nor for any unused portion of rent from a guest currently registered or any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, to arrive after the Hurricane Warning is lifted. This underpins the importance the importance of guests securing appropriate travel insurance.
14. FORCE MAJEUR
The Owners will not be liable for any loss, inconvenience or delay occasioned by failure of utility suppliers, strikes, riots, political unrest, hostilities, threat of war, terrorist activity, closure of airports, floods, adverse weather, third party intervention or any other event beyond their control, but will do their utmost to help in any such situation.
The Owners reserve the right to terminate occupation of the property in the event that an individual or group conduct themselves in an inappropriate or disorderly way. This relates to behaviour that is such that it is likely to cause distress, damage, danger or annoyance to any other person. The Owners will not be liable for any refund, compensation or any other costs incurred by an individual or a group in these circumstances. The Owners do not accept ant liability for any such behaviour of any third party.
16. PROBLEMS or COMPLAINTS
If you experience any problems with the property you must initially contact our local representative, who will do their utmost to rectify the matter as soon as is practically possible. Great effort has been taken to ensure information regarding Ffryes Villa is accurate. However content and circumstances are subject to change and whilst we will make every endeavour to notify you of any change(s) that we are aware of, we cannot be held responsible for any errors, omissions and changes beyond our control.
